NTMP Copy Available?

It would be useful if someone could pick up a copy of the NTMP once it if filed and scan it so folks could review it on-line and prepare for the public hearing.

I have had the most success with contesting THPs and NTMPs when I picked at them for non-compliance with the rules.

Also, has there been any discussion about filing a request for a temporary injunction until such time as the the water company posts a bond to cover any road damage, water damage, property loss, etc?

I would be happy to prepare the legal paper work and file it in the federal court if people are interested in that.

Communications

The communications within NAIL are not very good. We have a nice posting by Elise Moss, but no indication of how to communicate with her about it, no telephone, not accepting email, etc.

I make the same comment about communication with regard to all members of the steering committee of NAIL. It seems to me that there needs to be clearly posted on the website some contact information for each person active in leading this enterprise, or at least some central point of contact (i.e., a real person). Not to have this is quite frustrating.

NTMP has not been filed

The NTMP has not been filed yet, and there is some discussion that submission (noticed by Big Creek for September 10) may be further delayed now that San Jose Water is aware of the many concerns of the area residents. I will be helping members of NAIL review the NTMP once it is submitted and has been accepted for filing by the California Department of Forestry (CDF). I agree that it is extremely important to make sure the NTMP complies with the Forest Practice Rules.

Regarding filing injunctions or TROs (temporary restraining orders), it is quite premature to talk about such things. First things first. If, once the NTMP has been reviewed, there is strong consensus that bonds should be posted for damage to county roads, the first step would be for the county to make such a request as part of the Review Team.

And, of course, the NTMP would need to be approved by CDF before any legal action on the conditions of the plan would be required or appropriate. NAIL has a legal team which will be staying on top of such issues.
